The H2B working visa is a nonimmigrant visa which allows foreign nationals to enter into the U.S. temporarily and engage in nonagricultural employment which is seasonal, intermittent, a peak load need, or a one-time occurrence.
The H-2A temporary agricultural visa is a nonimmigrant visa which allows foreign nationals to enter into the U.S. to perform agricultural labor or services of a temporary or seasonal nature. |

Cost:
Option 1. Total cost is $1,110 to $2,385 to process entire group of workers any size. (Your costs are noted in bold print in the process described below.)
Option 2: Hourly assistance is available at $75/hour.
Optional help for workers at the consulate is $50 - $100 each.
Steps:
1. ($750 for complete service for group of any size) Complete the application data form and return to Micosta.
Approx. 60 days:
2. Micosta will send a cover letter and form 750a to your state DOL to initiate the application process. Applications are to be sent in 60-120 days before date workers are needed.
3. (Newspaper ad approx. $25 - $300)The state DOL will 1. suggest application modifications if necessary, 2. issue advertising instructions and direct client as to where and when to place newspaper ad. Ten day recruitment process takes place.
4. Client will interview any job applicants and send recruitment results to Micosta.
5. Micosta will send advertising results to the state DOL, and they will finish processing the application, sending it on the US DOL.
6. USDOL will send labor certification to Micosta for next stage.
Approx. 2 weeks to 2 months:
7. (Cost $185 form I-129 and $1,000 for the optional Premium Processing service. Anti-fraud charge starting October, 2005 is $150.) Micosta will complete forms I-129 and Premium Processing as needed and send forms to USCIS. Forms processed by Premium Processing will be complete in two weeks. Forms without Premium Processing take approximately two months for processing.
8. USCIS will process the form and return a Notice of Action for use by the workers at the interview at the US consulate.
Approx. 1 week:
9. Micosta will help client complete any paperwork necessary for the US consulate.
Approx. 1 week:
10. Optional: (Cost between $50 and $100 per worker paid by worker or client depending on number of workers and location) Micosta will assist the workers through the interview process including paperwork and preparing for the interview.
11. Micosta will help resolve any problems encountered by workers when crossing the US border.
12. Micosta will arrange airline tickets for workers on a non-commissioned basis. A flat $10 service charge will apply. (Compare our rates with internet and other agencies.)
Our obligation to you:
1. Answer questions you may have about the process before it begins and while it is moving along.
2. Submit all necessary paperwork and solve problems to the best of our ability as we work with the client and government agencies to process paperwork and workers.
3. Assist in processing replacement workers as necessary.
4. Guarantee: 1. Refund $ 400 if labor certification is denied at state or federal level.
5. Refund $ 300 if Notice of Action denied by USCIS.
Client responsibilities:
1. Return paperwork requested and place newspaper ad in a timely manner.
2. Provide accurate information.
3. Maintain communication as needed with Micosta.
4. Sign papers and return in a timely manner. |
